Copyright and takedown procedure
Our commitment to protecting creative works, and the procedure for reporting content that infringes your rights.
Preamble. Libertizy respects the intellectual property of others and expects its members to do the same. This policy describes how you can report to us content that may infringe your copyright, as well as the takedown procedure we apply. It supplements our Terms of Service and our Code of Conduct, with which it forms a coherent whole.
1. Respect for intellectual property
The texts, images, videos, logos and graphic elements featured on Libertizy are protected by copyright and trademark law. Any unauthorised reproduction, performance or distribution is prohibited. We implement the means necessary to prevent and put a stop to any infringements reported to us.
2. Content published by members
Libertizy hosts content uploaded by its members (photographs, videos, stories and descriptions). Each member warrants that they hold all rights in the content they publish and undertakes not to infringe any third-party right. In its capacity as a hosting provider, Libertizy does not carry out systematic prior control over this content, but promptly removes any manifestly unlawful content notified to it under the conditions set out below.
3. How to report an infringement of your rights
If you believe that content accessible on Libertizy infringes a copyright you hold, please send us a written notification. To be processed effectively, your notification must include the following elements:
- your full contact details: name or company name, postal address, email address and, if possible, telephone number;
- precise identification of the protected work to which your rights relate;
- precise identification of the disputed content, together with its exact location on the site (the URL address or addresses of the page or media concerned);
- a statement that you are the holder of the rights invoked, or duly authorised to act on behalf of the rights holder;
- a statement that you believe, in good faith, that the disputed use was not authorised by the rights holder, by its representative, or by law;
- a statement, made under your own responsibility, attesting to the accuracy of the information provided;
- your signature, handwritten or electronic.
4. Processing of your report and takedown
As soon as we receive a complete notification, we acknowledge receipt and proceed to review it as promptly as possible. Where the infringement is established, the content concerned is removed or made inaccessible, and the member who published it is informed. An incomplete notification may be the subject of a request for further information before it is processed.
5. Challenge by the member
A member whose content has been removed may challenge this decision by sending us a reasoned counter-notification, including their identification, a description of the content removed and the reasons why they believe they hold the necessary rights. After review, the content may be reinstated if the challenge appears well-founded, without prejudice to the remedies available to the parties.
6. Repeat infringement and account closure
In accordance with our Terms of Service, the account of a member who is the subject of repeated and established copyright infringements may be suspended, and then terminated.
7. Applicable legal framework
Libertizy is a service established in France. The handling of reports falls within the framework of the French Act for Confidence in the Digital Economy (LCEN) and the European Union’s Digital Services Act (DSA). The mechanism described above is also compatible with the notice-and-takedown procedure set out by the US Digital Millennium Copyright Act (DMCA), for situations in which the latter may apply.
8. Contact details of our Copyright Officer
Any notification or counter-notification must be sent to our Copyright Officer:
- by email: contact@libertizy.com;
- via our Contact page.
We invite you to keep a copy of your notification. The information you send us on this occasion is processed in accordance with our Privacy Policy.
