The terms of sale applicable to the Libertizy shop.
Notice. These Terms of Sale (hereinafter the “Terms of Sale”) exclusively govern the paid-for supply of the services and products offered by Libertizy. They supplement the Terms of Service (“Terms of Service”), the Privacy Policy and the Code of Conduct, to which they refer and with which they form an indivisible contractual whole. In the event of any contradiction relating to a purchase, these Terms of Sale shall prevail.

2. Purpose and Scope
These Terms of Sale set out the conditions under which Libertizy sells and supplies its Services and Products, and govern the rights and obligations of the parties in connection with any purchase.
They apply to any order placed on the Platform, to the exclusion of any other terms. Placing an order constitutes full, unreserved acceptance of these Terms of Sale, which the Customer acknowledges having read and expressly accepted, by ticking a box, prior to confirming payment.
Libertizy reserves the right to amend these Terms of Sale at any time. The applicable Terms of Sale are those in force on the date of the order. Any new order is governed by the Terms of Sale in force on that date.
3. Seller’s Identity and Contact Details
The Seller’s full identity, corporate form, registered office, registration details and contact information are set out in the Legal Notice in Part III, which forms an integral part of these Terms of Sale.
To be completed / to be validated — Set out in Part III the company name, legal form, share capital, RCS/SIRET number, intra-Community VAT number, registered office address, customer service e-mail address and telephone number, and the name of the publication director.
4. Access to the Service – Capacity – Age of Majority
The Platform and all Services and Products are strictly reserved for adult natural persons, at least 18 years of age in France and, in any event, having reached the age of majority in the State from which they access the Service.
By placing an order, the Customer represents and warrants that: (i) they are of legal age and have the legal capacity to contract; (ii) they are acting solely for personal, non-professional and non-commercial purposes; (iii) the information they provide is accurate, complete and up to date. Any false statement that is detected may result in immediate termination, without refund, and is the sole responsibility of its author.
Access to certain features or explicit content is subject to age verification and, where applicable, to a profile verification level (see Terms of Service). The use of tools that mask connection data (anonymising VPN, TOR, anonymous proxy) may, for security and fraud-prevention reasons, result in access being refused.
5. Description of Paid Services and Products
Registration on the Platform is free of charge. Access to certain features requires the purchase of a Subscription or Tokens; publishing an event listing is reserved for Professional or Partner accounts. The Shop will also offer Products for sale. The essential characteristics of each offer are presented on the Platform’s dedicated pages at the time of ordering.
5.1 Premium Subscription “Unlimited Access”
The Premium Subscription grants extended access to the Platform’s features, including unlimited messaging, broader access to profiles and content, and features reserved for subscribed Members, as described on the “Offers” page in force at the time.
The Subscription is offered for fixed terms (for example monthly, quarterly or annual). It is automatically renewable under the conditions set out in Article 9. Access is opened as soon as payment is confirmed.
To be completed / to be validated — Insert here the exact Subscription price list (terms and amounts, tax included), as displayed on the “Offers” page, together with details of the features included at each level.
5.2 Chat Tokens
Tokens are paid digital units allowing a Member to offer a non-subscribed profile the opening of a conversation: if the recipient accepts the Token, the two Members may exchange freely for a period of seven (7) days. Tokens are sold in packs, at the prices displayed on the “Offers” page, shown below for information purposes as at the date of these Terms of Sale:
| Pack | Tokens | Price (tax incl.) | Price / token |
| Starter Pack | 3 tokens | 10,00 € | 3,33 € |
| Advantage Pack | 5 tokens | 12,00 € | 2,40 € |
| Eco Pack | 10 tokens | 15,00 € | 1,50 € |
Validity. Each Token is valid for six (6) months from the date of its purchase. After this period, any unused Token automatically expires and is permanently lost, without giving rise to any refund, replacement or compensation. Tokens have no monetary value and are neither transferable, exchangeable, nor convertible into money. The credit of Tokens is deemed to be fully supplied as soon as it is made available in the Customer’s account (see Article 11.2).
5.3 Referral Programme – Free Days
The Referral Programme allows a verified Member to invite someone they know: as soon as the invitee is verified, both the referrer and the invitee receive free access days, within the limits of the caps displayed (for information purposes: up to 60 cumulative days over a rolling 12-month period, 3 invitations per 30 days, 8 active referrals per 12 months).
The free days constitute a free, revocable commercial benefit. They have no monetary value and are neither transferable, refundable, nor convertible into money. The programme is reserved for verified profiles and is subject to the anti-fraud rules detailed in the Terms of Service: in particular, self-referral, the creation of multiple or fictitious accounts, the use of disposable e-mail addresses, the manipulation of IP addresses or device fingerprints, and any circumvention of the caps are prohibited. Each referral is subject to a 48-hour security period, an automatic risk assessment and, where applicable, a manual review. In the event of proven fraud or serious suspicion, Libertizy may suspend the grant, cancel any days or Tokens already credited, and suspend or delete the accounts concerned, without notice or compensation.
5.4 Event Listings (Parties, Clubs, Weekends & Trips)
The Platform allows Professional or Partner accounts, previously validated and holding an active subscription, to publish event listings (parties, clubs, weekends, trips). These listings constitute visibility spaces: Libertizy does not organise these events, does not handle ticketing for them, and does not collect any participation fees. The organiser is solely responsible for the running, content, safety and compliance of their event, as well as for compliance with applicable laws and regulations (in particular authorisations, safety, hygiene, taxation and regulations applicable to premises open to the public).
a) Paid publication. Publishing a listing is a paid service, charged at 29,90 € (tax incl.) per listing, for 30 days of visibility from the date of publication. The listing is first submitted to Libertizy’s moderation; payment is only taken after approval. No payment is due if the listing is refused.
b) Renewal. Upon expiry of the 30-day period, the listing may be renewed for a further 30-day period, at the same price. Where the content of the listing is unchanged, renewal does not require new moderation.
c) Locked content and accuracy. Once the listing has been approved, its content is locked. The organiser warrants the accuracy of the information published and undertakes not to publish any misleading, unlawful or duplicate listing.
d) Invoicing. Publication of a listing is invoiced in the name of the professional organiser, with the particulars set out on the document made available in their account. A discount of 0,75 € may apply to the first listing of an organiser who has completed profile verification by payment.
e) No refund. The publication price is non-refundable once the listing has been approved and published, the service then being deemed performed. Cancellation of the event by the organiser does not give rise to any refund of the publication price.
f) External ticketing. Where ticketing, booking or paid registration is offered for an event, it is provided exclusively by the organiser through their own means. Libertizy is not a party to it, does not collect any sums in that respect, and cannot be held liable for its performance.
5.5 Shop – Products
The Shop will offer Products for sale (adult accessories and items). Products are described and presented with the greatest care; photographs and descriptions have no absolute contractual value as regards minor differences. Product offers are valid while stocks last.
Orders for Products carry a right of withdrawal under the conditions and limits set out in Article 11.4, and the statutory warranties set out in Article 13. Delivery arrangements, timeframes and costs are indicated before the order is confirmed.
To be completed / to be validated — To be completed when the Shop opens: delivery terms (carriers, zones, timeframes, costs), return policy and logistics model. Check VAT liability and the display of any applicable eco-contributions.
5.6 Lives & Webcams (feature coming soon)
The live-streaming feature (“Lives & Webcams”), currently under development, will allow logged-in Members to broadcast and watch live streams. Once offered for a fee, it will constitute Digital Content subject to these Terms of Sale, in particular Articles 11.1 (withdrawal) and 17 (liability). Specific terms and pricing will be communicated at launch.
6. Price
Prices are shown in euros, inclusive of all taxes (tax incl.). They are the prices in force and displayed on the Platform at the time the order is confirmed. Libertizy reserves the right to change its prices at any time; Products and Services are invoiced on the basis of the prices in force when the order is recorded. For renewed Subscriptions, any price change is notified to the Customer under the conditions set out in Article 9, the Customer retaining the right to cancel before the new price takes effect.
7. Order and Formation of the Contract
Placing an order requires creating an account, selecting the offer, the Customer checking the order summary (nature, price, duration, possible renewal), expressly accepting these Terms of Sale, and then confirming payment. The sale is completed and the contract formed when payment is confirmed by the PSP. A confirmation e-mail summarising the order is sent to the Customer, who should keep it; it may be requested in the event of a complaint or dispute.
Libertizy reserves the right to refuse or cancel any order from a Customer with whom a payment dispute exists, or in the event of suspected fraud, professional use, or breach of these Terms of Sale.
8. Payment Terms – Security – Fraud
Payments are made online, by payment card and, where applicable, by the other means offered on the Platform. Payment processing is carried out by an authorised PSP, using a secure connection. Libertizy never has access to the Customer’s card data and does not store it; this data is processed and, in the case of a subscription or recurring payment, retained by the PSP for the period strictly necessary to carry out the payments.
For reliability and cardholder-protection reasons, certain virtual, prepaid or foreign chipless cards may be declined. The Customer warrants that they hold the card used and are authorised to use it.
In the event of non-payment, rejection, fraud or an abusive dispute (chargeback) of a payment that is nonetheless due, Libertizy reserves the right to suspend access until the situation is regularised, to recover the sums owed and, within the limits permitted by applicable regulations, to report the incident to its PSP in order to prevent recurrence, without Libertizy retaining any card data.
9. Term and Automatic Renewal of the Subscription
The Subscription is taken out for the initial term chosen by the Customer. For the Customer’s convenience and to ensure continuity of service, it is automatically renewed, on expiry, for successive periods equal to the initial term, with the corresponding price debited automatically on each anniversary date, until cancelled under the conditions set out in Article 10.
Annual notice (Article L. 215-1 of the French Consumer Code (Code de la consommation)). Libertizy shall inform the Customer, in writing (by e-mail), at the earliest three (3) months before the end of the current period for subscriptions longer than 3 months, 1 month for subscriptions shorter than 3 months and 10 days at the latest for monthly subscriptions, of the deadline by which they may object to the automatic renewal. Where this information has not been sent to the Customer in accordance with the law, the Customer may terminate the Subscription free of charge, at any time from the renewal date; any sums paid in advance after the last renewal date shall then be refunded, less the amounts corresponding to use of the service up to termination.
10. Cancellation of the Subscription at the Customer’s Initiative
The Customer may stop the renewal of their Subscription at any time, free of charge and without giving a reason, directly from their personal account (the “My Account” section / subscription management). Cancellation stops automatic renewal while allowing the Customer to continue to benefit from access until the end of the period already paid for. It does not give rise to any refund of the current period.
“Three-click” cancellation (Article L. 215-1-1 of the French Consumer Code (Code de la consommation)). For any Subscription taken out electronically, Libertizy provides, at all times and on a permanent basis, a free and directly accessible feature allowing cancellation online through a simple and understandable process. Cancellation takes effect at the end of the current period, subject, where applicable, to the notice period displayed.
To be completed / to be validated — Ensure that the online cancellation process complies with French Decree No. 2023-182 (a permanently accessible “cancel your contract” button). Specify, if one is introduced, the exact notice period and the account deletion/reactivation window (30 days).
Libertizy may, for its part, cancel or suspend the Subscription under the conditions set out in Article 16.
11. Right of Withdrawal
The right-of-withdrawal regime differs depending on the nature of what is purchased. The provisions below reproduce and implement the exclusion cases provided for by the French Consumer Code (Code de la consommation).
11.1 Subscription and Digital Content – Express Waiver
The Subscription, paid Lives and, more generally, services and digital content supplied immediately constitute the performance of a service that is fully performed before the end of the withdrawal period and/or the supply of digital content not provided on a physical medium, the performance of which begins immediately. By ticking the box provided for this purpose when ordering, the Customer expressly requests the immediate performance of the service and acknowledges that they will lose their right of withdrawal once the service has been fully performed (Article L. 221-28, 1° of the French Consumer Code (Code de la consommation)), or expressly consents to the immediate commencement of the supply of the digital content and waives their right of withdrawal (Article L. 221-28, 13°). Accordingly, no right of withdrawal may be exercised for these services.
11.2 Chat Tokens – Express Waiver
Tokens are made available immediately in the Customer’s account and are immediately usable. The Customer expressly requests their immediate supply and acknowledges that, as a result, they lose their right of withdrawal. Tokens are in any event non-refundable, including in the event of expiry at the end of their validity period.
11.3 Events and Ticketing – Legal Exclusion
Publishing an event listing is addressed to professionals acting within the scope of their business activity; it constitutes a service performed as soon as the listing is approved and published, and does not fall within the right of withdrawal granted to consumers. The terms specific to each listing (visibility period, renewal) are recalled before payment.
11.4 Shop – 14-Day Right of Withdrawal and Exclusions
For Products purchased in the Shop, the Customer has a period of fourteen (14) days from receipt of the Product to exercise their right of withdrawal, without having to give a reason. To exercise it, the Customer informs Libertizy of their decision by means of an unambiguous statement (for example using the standard form set out in the Appendix, or by e-mail to customer service). Products are returned, within 14 days of the decision being communicated, complete and in their original condition; return costs remain the Customer’s responsibility, unless stated otherwise. The refund is made within 14 days, using the same means of payment, and Libertizy may defer the refund until the Product has been recovered or proof of its dispatch has been provided.
Exclusions (Article L. 221-28 of the French Consumer Code (Code de la consommation)). The right of withdrawal cannot be exercised, in particular, for: goods made to the Customer’s specifications or clearly personalised (3°); goods that have been unsealed after delivery and cannot be returned for reasons of health protection or hygiene (4°), which applies in particular to intimate and sexual wellness items once their sealed packaging has been opened; unsealed audio, video or software recordings (9°). These exclusions are brought to the Customer’s attention before ordering.
12. Refunds – No Refund
Except where mandatory legal provisions state otherwise or as expressly provided herein, sums paid are non-refundable. In particular, no refund shall be given for: the current Subscription period in the event of cancellation or account deletion; used or expired Tokens; Referral Programme benefits; Event Bookings (except where Libertizy cancels an Event it organises); or cases of suspension or termination for breach under Article 16. Where a refund is due, it is made using the same means of payment as that used for the order.
13. Statutory Warranties (Shop Products)
Independently of any commercial warranty, Products benefit from the following statutory warranties, the provisions of which Libertizy sets out below:
Statutory warranty of conformity (Articles L. 217-3 et seq. of the French Consumer Code (Code de la consommation)). The Customer has a period of two (2) years from delivery of the Product within which to take action; they may choose between repair or replacement, subject to the cost conditions provided for by law, and benefit from a presumption that the defect existed at the time of delivery. They are exempt from having to prove the existence of the lack of conformity during the twenty-four (24) months following delivery.
Warranty against hidden defects (Articles 1641 et seq. of the French Civil Code (Code civil)). The Customer may decide to invoke the warranty against hidden defects in the item sold; they may then choose between rescission of the sale or a price reduction, in accordance with Article 1644 of the French Civil Code (Code civil), within two (2) years from discovery of the defect.
To be completed / to be validated — When the Shop opens, insert the mandatory legal notices on warranties (information box and procedure for invoking them) and, where applicable, the availability of spare parts.
14. Validity Period of Tokens and Benefits
Tokens are valid for six (6) months from the date of purchase; free days granted under the Referral Programme are subject to the caps and periods displayed. Upon expiry, unused Tokens and benefits are permanently lost, without refund or compensation. Token and benefit balances can be viewed from the Customer’s personal account.
15. Buyer’s Obligations
The Customer undertakes to use the Services and Products in accordance with their intended purpose, these Terms of Sale, the Terms of Service and the Code of Conduct, for strictly personal and non-commercial purposes. In particular, the Customer shall not engage in any fraudulent use, resale, sharing of their account or login credentials, use for purposes of prostitution, solicitation or touting, or any attempt to circumvent security measures or caps. Only one account per person is permitted.
16. Suspension and Termination for Breach
In the event of a breach by the Customer of these Terms of Sale, the Terms of Service or the Code of Conduct, or in the event of fraud, identity theft, false statements, unlawful content, or conduct harmful to other Members or to the Platform, Libertizy may, without notice or prior formal notice and at its sole discretion: restrict access, remove content, suspend or delete the account, and terminate any current Subscription.
In these cases, no sums paid are refunded, Tokens and benefits are forfeited, and Libertizy reserves the right to claim compensation for losses suffered by itself or by third parties. These measures are without prejudice to any other right or action available to Libertizy.
17. Liability – Exclusions – Force Majeure
Libertizy supplies its Services under a best-efforts obligation. Given the constraints inherent in the Internet, Libertizy does not guarantee the permanent availability, continuity or security of access and transmissions. Its liability cannot be engaged in the event of malfunction, unavailability or interruption attributable to the Customer’s access provider, network congestion, unsuitable equipment, maintenance operations, or any external cause.
Libertizy is not responsible for the accuracy of information and content published by Members, nor for relationships, exchanges or meetings between Members, nor for Events organised by Members. Members are strongly advised to exercise caution, to choose a public place for a first meeting, to inform someone they trust, and not to disclose any personal or banking data.
To the extent permitted by law, the liability of Libertizy, if established, shall be limited to direct, personal and certain damage, and shall not exceed the amount actually paid by the Customer for the order giving rise to the damage over the preceding twelve (12) months. None of these limitations shall apply in the event of personal injury, gross or intentional misconduct, or in cases where the law prohibits it.
Neither party’s liability may be engaged in the event of force majeure within the meaning of Article 1218 of the French Civil Code (Code civil) and the case law of the French courts.
18. Hosting Provider and Intermediary Status – Reporting
With regard to content published by Members and Events organised by Members, Libertizy acts as a hosting provider within the meaning of Article 6 of French Law No. 2004-575 of 21 June 2004 and is not subject to any general obligation to monitor content. A reporting mechanism (“Alert the moderator” / “Safety & Reporting”) allows any manifestly unlawful content to be reported, which Libertizy undertakes to remove promptly upon proper notification, and to report to the competent authorities where required by law.
19. Intellectual Property and Content Licence
All elements of the Platform (the Libertizy trademark, logo, text, interfaces, graphics, databases, software) are the exclusive property of Libertizy and are protected by intellectual property law. Any unauthorised reproduction, representation or use is prohibited.
Subject to content shared in “private” mode, any Member who uploads content (photograph, video, text, audio) grants Libertizy a free, non-exclusive, worldwide licence, for the duration it remains online, to reproduce, represent, adapt and distribute that content on any communication medium of the Platform, for the purposes of operating and promoting the Service. The Member warrants that they hold all rights and authorisations necessary for the content they publish and shall hold Libertizy harmless against any claim in that respect. The specific rules applicable to editorial contributions (stories, blog) are set out in the Terms of Service.
20. Personal Data
The processing of personal data carried out in connection with orders and use of the Service is described in the Privacy Policy (GDPR), which sets out the purposes, legal bases, retention periods and the rights of individuals (access, rectification, erasure, objection, portability). Data strictly necessary for payment is processed by the PSP. Any special categories of sensitive data disclosed by the Member (orientation, practices) are processed only on the basis of their express consent.
To be completed / to be validated — Check consistency with the Privacy Policy (contact details of the data controller, any DPO, retention periods, processors including the PSP and the hosting provider, transfers outside the EU).
21. Customer Service and Complaints
For any question or complaint relating to an order, the Customer may contact customer service using the contact details set out in the Legal Notice and on the “Contact & Support” page. The Customer is advised to keep the confirmation e-mail and proof of payment.
22. Consumer Mediation and Online Dispute Resolution
In accordance with Articles L. 611-1 et seq. and R. 612-1 et seq. of the French Consumer Code (Code de la consommation), a consumer Customer has the right to have free recourse to a consumer mediator with a view to the amicable resolution of a dispute with Libertizy, after first attempting to resolve it by means of a written complaint to customer service. The contact details of the competent mediator are as follows:
To be completed / to be validated — Indicate the name, postal address and website address of the consumer mediator to which Libertizy is affiliated (affiliation is mandatory). Without a designated mediator, this clause is incomplete.
The Customer may also use the European online dispute resolution (ODR) platform: https://ec.europa.eu/consumers/odr.
23. Governing Law and Competent Jurisdiction
These Terms of Sale are governed by French law and shall be interpreted in accordance with it. Failing an amicable resolution, any dispute relating to their validity, interpretation or performance shall be brought, at the consumer’s choice, before one of the courts having territorial jurisdiction under the French Code of Civil Procedure (Code de procédure civile), or before the court of the place where the consumer resided at the time the contract was entered into or the harmful event occurred. Consumers residing outside France retain the benefit of the mandatory provisions of the law of their country of residence, in accordance with Regulation (EC) No. 593/2008 (Rome I).
24. Miscellaneous Provisions
Amendment. Libertizy may amend these Terms of Sale at any time. The applicable Terms of Sale are those in force on the date of the order.
Partial invalidity. If any provision of these Terms of Sale is declared void or deemed unwritten, the other provisions shall remain in full force and effect.
No waiver. The fact that Libertizy does not rely on a provision shall not be construed as a waiver of the right to rely on it at a later date.
Entire agreement. These Terms of Sale, together with the Terms of Service, the Privacy Policy and the Code of Conduct, express the entire agreement of the parties with respect to their subject matter.
Evidence. The computerised records and connection logs kept by Libertizy and its PSP shall serve as evidence, unless proven otherwise, of the orders, payments and communications that have taken place.
Language. These Terms of Sale are drafted in French, which shall prevail in the event of translation.
Terms of Sale last updated on 7 July 2026. This version supersedes and replaces any prior version.
