Terms of Service

1. Purpose

These Terms of Service set out the conditions for accessing and using the Libertizy Platform. They apply to every Member and form a contractual whole together with the Terms of Sale, the Privacy Policy and the Code of Conduct.

2. Access Reserved for Adults

The Service is strictly reserved for adults (18 years of age or older). Access to explicit content is subject to compliant age verification. The Member warrants that they are of legal age and have full legal capacity.

3. Registration and Account

Registration requires a valid e-mail address, a username, and acceptance of legal age, of these Terms of Service, of the Terms of Sale, of the Privacy Policy and of the Code of Conduct. The Member undertakes to provide accurate, up-to-date information and not to create a profile that does not correspond to reality (in particular as regards type: man, woman, couple, transgender). Only one account per person is permitted. Each Member is responsible for the confidentiality of their login credentials and for any action carried out through their account.

4. Profile Verification

The Platform offers optional profile verification, designed to strengthen trust within the community. The “Verified” badge is obtained, at the Member’s choice, through one of the two paths described on the “Profile Verification” page: either a control micro-payment of 0,75 €, or a short video call with the moderation team. One method alone is enough; the two are never both required. Verification attests that a check has been carried out and does not constitute an absolute guarantee of the accuracy of the information provided. In the event of doubt, Libertizy may request additional verification and, failing that, restrict access to or delete the profile without a refund. The information provided is processed confidentially, with restricted access and minimal retention, in accordance with the Privacy Policy.

5. Member Conduct and Content

Respect, consent and discretion are required. In particular, the Member shall not: publish unlawful, defamatory, abusive, violent or hateful content, or content that infringes the protection of minors or the rights of third parties; post their personal contact details (phone number, e-mail, address, URL) in public areas; use the Service for the purposes of prostitution, solicitation, or professional or commercial activity; collect the data of other Members; advertise other services; or disrupt the operation of the Platform. Only photographs and videos of the profile holder(s) are permitted; content taken from the web, unsuitable, blurred, promotional or watermarked content is prohibited.

6. Subscriptions, Tokens and Payments

Premium offers, Tokens and other paid Services are described on the “Offers” page and governed by the Terms of Sale (Part I), to which reference is made for the conditions of pricing, renewal, withdrawal, termination and refunds. Payments are secure; no card data is stored by Libertizy.

7. Referral Programme and Tokens – Anti-Fraud Rules

The Referral Programme and the Token system are reserved for verified profiles. Free days and Tokens have no monetary value, are neither transferable nor refundable, and cannot be converted into cash. The following are strictly prohibited and result in the cancellation of any benefits: self-referral, the creation of multiple or fictitious accounts, the use of disposable or temporary e-mail addresses, the manipulation of an IP address or device fingerprint, and any circumvention of the caps (60 cumulative days over a rolling 12-month period, 3 invitations per 30 days, 8 active referrals per 12 months). Each referral is subject to a 48-hour security hold, an automated risk assessment and, where applicable, a manual review. In the event of proven fraud or serious suspicion, Libertizy may suspend the granting of benefits, cancel any credited days or Tokens, and suspend or delete the accounts concerned, without notice or compensation.

8. Editorial Contributions (Blog, Stories)

Submitting stories or contributions is reserved for verified profiles holding a currently valid subscription. By submitting content, the Member certifies that they are of legal age and hold all rights in the material provided, which must be free of any third-party rights. The Member assigns to Libertizy ownership of the content submitted; they remain credited as the author of their contribution. Libertizy may accept, refuse, edit or adjust content for editorial and search-optimisation purposes prior to publication, and may withdraw it at any time. Publication only takes effect once approved by the moderation team.

9. Moderation and Reporting

Libertizy acts as a hosting provider for Member content and operates a reporting mechanism. Every report is reviewed by the moderation team, which decides on the appropriate follow-up action. Libertizy may modify or remove content, restrict access, add notices (for example “certified member”), amend a non-compliant username, and take any suspension or deletion measures in the event of a breach.

10. Liability

Libertizy implements the resources necessary for security and moderation, without guaranteeing the accuracy of the information provided by Members or the outcome of any meetings. The provisions of Article 17 of the Terms of Sale shall apply.

11. Term, Suspension and Termination

The Member may delete their account at any time from their account area, with a 30-day reactivation window. Libertizy may suspend or terminate an account in the event of a breach, under the conditions set out in Article 16 of the Terms of Sale. In the event of deletion or banning, profile data is retained for evidentiary purposes and for the management of abuse for a limited period, in accordance with the Privacy Policy, before permanent deletion.

12. Personal Data

Data processing activities are described in the Privacy Policy (GDPR). Any sensitive data disclosed by the Member is processed solely on the basis of their express consent.

13. Governing Law

These Terms of Service are governed by French law. The provisions relating to consumer mediation and competent jurisdiction set out in Articles 22 and 23 of the Terms of Sale shall apply.
